Means, for any Capacity Committed CMU and Delivery Year or part of a Delivery Year: (a) the person who was the Applicant for that CMU at Prequalification; or (b) if a transfer of the Capacity Agreement for that CMU and Delivery Year or part of a Delivery Year has been registered on the Capacity Market Register, the transferee.
