Electricity Settlements Company (ESC) and EMRS would like to make Suppliers aware that following the publication of a consultation on 19 December 2018 by BEIS (consultation on Technical Changes to the Capacity Market), a Modification ‘P378’ to the Balancing and Settlement Code (BSC) was raised on 20 December 2018.

The BEIS consultation follows the 15 November 2018 judgment of the General Court of the Court of Justice of the European Union, which had the effect of removing the European Commission’s State aid approval for the GB Capacity Market scheme and introducing a standstill period. BEIS in its consultation document confirms it is minded to continue to collect payments from Suppliers during the standstill period. BEIS is consulting on two options:

  1. ESC to continue to collect the Supplier Charge; or
  2. A Modification to the Balancing and Settlement Code (BSC).
